IU McKinney Alumnus Named Indiana Trial Lawyer of the Year
Daniel A. Ladendorf, ’86, has been named Trial Lawyer of the Year for 2013 by the Indiana Trial Lawyers Association (ITLA). The award recognizes his multi-year effort to change the state’s hospital lien statute, which was successful during the 2013 session of the Indiana General Assembly.
Ladendorf was inspired to push for this reform after working on a wrongful death claim for the estate of a woman who died several weeks after a car crash in 2008. The accident was caused by another driver who failed to yield the right of way. Hospitals are now prohibited from asserting a lien against a Medicare patient who requires services as a result of someone else’s actions.
In testifying before state committees on this issue, Ladendorf said “The hospital should not reap a windfall at the expense of the injured patient by collecting its full charges when it is otherwise obligated to accept a reduced amount based on Medicare reimbursement rates or a privately negotiated agreement with a health plan. The price a patient pays for hospital services should not depend on the circumstances that required the patient’s care.”
The award was presented at the ITLA annual conference in Indianapolis in early November 2013.
