In May, the Office of Civil Rights of the Department of Health and Human Services issued a final rule implementing Section 1557 of the Patient Protection and Affordable Care Act. Section 1557 prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in health programs or activities, and the requirements apply hospitals, skilled nursing facilities, home health agencies, ambulatory surgery centers, hospices, home health agencies, community mental health centers, laboratories, pharmacies, and physicians.
This presentation will discuss the four main components of Section 1557: (i) prohibiting sex discrimination, including on the basis of gender identity; (ii) meaningful access for individuals with limited English proficiency; (iii) effective communication with and accessibility for individuals with disabilities; and (iv) preventing discrimination in health insurance coverage as well as the new obligations on providers and the deadlines for compliance.
