In recent years, employee non-competition agreements have been scrutinized (and challenged) by a number of state and federal agencies. In health care, there are strict limits on the way in which physician non-competition agreement can be used under Indiana law.
Presenters will discuss both Indiana’s statutory limitations on non-competition agreements for physicians and the status of the laws on the use and enforcement of non-competition agreements more generally, including the status of attempts to limit or eliminate non-competition agreement by the Federal Trade Commission and the National Labor Relations Board.

About the Speakers:

Tami Earnhart
Tami Earnhart is a partner at Ice Miller and a member of the firm’s Workplace Solutions Group and Health Care Group. She represents employers in all aspects of employment and labor law, including discrimination and other litigation, claims filed with administrative agencies, and labor arbitrations. She helps employers avoid employment disputes, when possible, and advises companies in making personnel decisions and creating policies in compliance with state and federal laws, including FMLA and affirmative action policies.
Tami frequently trains boards, human resources professionals, managers and non management employees on issues such as discrimination, harassment, discipline and discharge, hiring practices, and FMLA compliance. She also regularly defends employers in discrimination, wage and hour, and other litigation before state and federal courts; claims filed with administrative agencies such as the Equal Employment Opportunity Commission and the Indiana Civil Rights Commission; and labor arbitrations. In addition, she has prepared articles and is a frequent speaker on employment issues, such as harassment, FMLA, health care reform, affirmative action and the Fair Labor Standards Act.
Originally from Elkhart, Indiana, Tami received her Bachelor of Science in legal administration from the University of Evansville, graduating magna cum laude. Tami earned her juris doctor, magna cum laude, from Indiana University Maurer School of Law and was elected to the Order of the Coif. While attending law school, she served as senior managing editor for the Indiana Law Journal and the publicity coordinator for the Sherman Minton Moot Court Board.

Taryn Stone
Taryn Stone is a partner and chair of the firm's Health Care Group, concentrating her practice on various aspects of health law. Taryn represents various providers and suppliers of health care services including hospitals, physicians, and medical device manufacturers on transactional and regulatory issues. Her practice includes counseling clients on matters involving Medicare conditions of participation, Medicare and Medicaid billing and reimbursement issues, the Stark and Anti-Kickback laws and similar state laws, the False Claims Act, HIPAA and other state privacy and security laws, and state licensure laws and regulations. She is also a member of the Firm's Internet of Things (IoT) Group.
Taryn has represented many health care providers on a wide variety of matters including structuring complex health care arrangements under the Stark and Anti-Kickback laws, the formation, operation and sale of physician group practices, negotiating contracts, mergers and acquisitions, employment matters and other business arrangements between providers, manufacturers and other entities.
Previously, Taryn served as in-house counsel for a large, publicly traded home health and hospice company. Taryn also worked as a health care consultant for a national consulting firm helping clients develop and implement co-management arrangements. Taryn graduated from Washington University in St. Louis in 2002 with a Bachelor of Arts. While at Wash U, she was captain of the Washington University Women's Swimming & Diving team. She received her juris doctor, magna cum laude, from Indiana University School of Law-Indianapolis in 2005. While in law school, she was an articles editor for the Indiana Law Review, a volunteer in the school's pro bono program, a member of the Health Law Society, and a member of the Dean's Tutorial Society.
