IU McKinney to Host Panel Discussion in Advance of US Supreme Court Argument

The Indiana University Robert H. McKinney School of Law Hall Center for Law and Health will host “Tax Credits and the Affordable Care Act: A Discussion of King v. Burwell and Indiana v. IRS.” a discussion of both cases. The event on March 3 will examine the latest challenges to the Affordable Care Act and will feature commentary from Indiana Solicitor General Thomas Fisher, and Professor David Orentlicher, Co-Director of the Hall Center for Law and Health.
On March 4, 2015, the United States Supreme Court will hear arguments in the King v. Burwell case. This case represents a challenge to the Patient Protection and Affordable Care Act’s (ACA) provisions providing subsidies in the form of tax credits for health insurance purchased through the ACA Exchange. At issue in the case is the question of whether these subsidies are available only within the 14 states that created state-run health insurance exchanges, or, alternatively, whether these tax credits are available to all eligible purchasers of health insurance from either state or federal exchanges.
A similar issue is currently argued in the locally-based case of Indiana v. IRS. In this challenge, Indiana and multiple school districts argue that schools and local governments are not subject to the ACA’s employer mandate because the tax credits contemplated by the ACA should be made available only to those who purchase insurance through state-run exchanges.
The event will begin at 12:45 p.m. on March 3 in Room 385 at Inlow Hall.
