Professor Katz Says the First Church of Cannabis Unlikely to Prevail Under RFRA

IU McKinney ​Professor Robert Katz commented on the legal issues raised by First Church of Cannabis ​under the free exercise of religion and Indiana’s Religious Freedom Restoration Act. He commented on the issue in a news story published May 21 in the Indianapolis Star. "It's not the type of plaintiff that was expected or that probably most supporters of RFRA had in mind,” Professor Katz in the news story.
In order to succeed, the church will have to prove it's a sincere religion, not just an excuse for users to get together and smoke, Professor Katz said. He expressed doubts that they'll get far. "That's mainly because these people, while they are nice and delightful, ... most judges would view them as goofballs," he said in the news story.
Professor Katz teaches courses on nonprofit law, the First Amendment, law and religion, and the law of healthcare organizations.
