IU McKinney Faculty to Discuss Some of Justice Scalia's Most Important Rulings

Members of the faculty of the Indiana University Robert H. McKinney School of Law and a guest from Elon University School of Law will gather on February 23 in the Wynne Courtroom at Inlow Hall for a special remembrance of the late United States Supreme Court Justice Antonin Scalia. During the event, which will begin at 5:30 p.m., they will discuss Justice Scalia’s leading opinions during his tenure on the court.
Topics will include:
“Justice Scalia and the Transformation of Statutory Interpretation” will examine the late justice’s “textualist” approach to interpretation. Professor Jeff Cooper will demonstrate how this played out in important cases.
“Justice Scalia in Dissent” will consider the impact of his minority opinions on the Supreme Court. Professor John Hill will offer this glimpse into Justice Scalia’s influence on the high court.
“Justice Scalia: A Reluctant Standard-bearer for Chicago-School Antitrust,” will examine his dissent in Eastman Kodak v. Image Tech.Servs., his majority opinion in Verizon v. Trinko, and his concurrence in F. Hoffmann-Laroche Ltd. V. Empagran. Professor Max Huffman will lead this discussion.
“Justice Scalia’s Probes at the Boundaries of Administrative Law” will note the marks he made in this field, considering his extensive background in this area of the law. Professor Florence Wagman Roisman will provide some analysis of this portion of Justice Scalia’s legacy.
“Scalia and the Sixth Amendment” will consider how the late justice changed the course of criminal prosecution with his majority opinions in Crawford and Apprendi. Professor Lahny Silva will provide this discussion.
"Justice Scalia and the Religion Clauses" will be the topic of discussion provided by Professor Scott Gaylord of Elon University School of Law.
