Professor Dannenmaier Comments on South Bend Smoking Ban

The city of South Bend is considering a ban on smoking and “vaping” in bars, taverns, casinos, private clubs, and tobacco shops. It would effectively expand the statewide ban to include all public places.
Supporters point to the public health good the measure would produce, while detractors promise a legal battle over their rights to choose to have an establishment that permits smoking.
Professor Eric Dannenmaier commented for a news story on the measure in the South Bend Tribune that was published March 20.
“Localities have the ability to extend the scope of the smoking ban that is otherwise in place at the state level,” Dannenmaier said in the news story. “There’s clearly a public health argument and a public health basis for public regulation.”
Professor Dannenmaier is a Dean’s Fellow, a Grimes fellow, director of J.D. Graduate Programs, and director of the Environmental Energy and Natural Resources Law Program at IU McKinney. He was appointed to the Joint Public Advisory Committee of the North American Commission for Environmental Cooperation by President Barack Obama in 2013.
