Professor Huffman Discusses E-Cig Regulations with Indiana Public Media

Indiana’s vaping law has some crying foul over the lack of competition created by the regulations. Prior to enactment, there were hundreds of manufacturers; now there are seven.
But that’s not illegal, Professor Max Huffman said in a news story for Indiana Public Media, broadcast September 6.
“The federal anti-trust laws would be terribly concerned if a group of private firms got together and said we’re going to keep out everybody except for seven,” Professor Huffman says in the story. “And I should just be clear, the Indiana anti-trust laws would also be concerned about that. But the illegality turns on private action. If the state wants to do something, the law doesn’t prohibit it.”
Professor Huffman is the faculty director for IU McKinney’s online program, and is the director of the Corporate and Commercial Law Graduate Certificate Program.
