Washington Post Calls on IU McKinney Professor to Discuss Trump Medical Record Seizure
05/03/2018
IU McKinney Law Professor Nicolas P. Terry was interviewed in a May 2 analysis in The Washington Post of an alleged “raid” of President Donald Trump’s personal physician’s office.
In the article, “Why the ‘Raid’ of Trump’s Former Doctor Isn’t Just a Funny Sideshow,” Professor Terry was asked whether Trump's bodyguard Keith Schiller, Trump Organization lawyer Alan Garten and another man had authorization to seize the files from the office of Trump physician Harold Bornstein.
According to the article: “If it was really a 'raid' and the doctor did not give his consent to his property being removed (or was intimidated into giving that consent) then it could constitute a common law claim for the tort of conversion,” said Terry, who emphasized that we don't have all the facts. “Also, I assume if there was any violence or threats then there could be some criminal issues.”
Professor Terry is the Hall Render Professor of Law and Executive Director of the William S. and Christine S. Hall Center for Law and Health. He teaches Torts, Products Liability, Health Information Technology, Law & Science, and Health Care Quality. His research interests lie primarily at the intersection of medicine, law, and information technology. He is a permanent blogger at Harvard Law School's Bill of Health. Professor Terry is also is the co-presenter of the “The Week in Health Law” podcast.
