Professor Drobac Discusses Proposed Title IX Changes

The clock is ticking on a 60-day public comment period for proposed changes regarding how school and universities handle sexual violence and harassment allegations. Professor Jennifer Drobac discussed the proposals, published in the Federal Register, for a story in the Terre Haute Tribune Star.
One of the biggest and most controversial proposed changes is the right to cross-examine the complainant. "That's really problematic," Professor Drobac said in the story. "This is not a courtroom setting, it's at a school. The question is — what are the rules of discovery and evidence in a nonjudicial setting? What if the complainant does not have a lawyer who can object? It's not clear to me how this right to cross-examination will be implemented."
Professor Drobac is the R. Bruce Townsend Professor of Law, and a well-known expert in the area of sexual harassment law. Her latest book, The Myth of Consent, which she is co-writing with Professor Oliver Goodenough, will explore the neuroscience of adult decision making and how the science should influence law reform.
