Professor Katz Says 'Watered-Down' Hate Crimes Bill 'Likely Unconstitutional'

Professor Robert Katz discussed the Indiana Senate's revision to the hate crimes bill with television station WTUI. It was the third interview he'd given on the topic in two days.
During the interview, which was broadcast February 22, Professor Katz said that the bill is "likely unconstitutional for violating the Due Process clause. This goes to one of the first principles of the rule of law, which is that people need to know what the law is before they can be punished for violating it." Professor Katz also said, "because you have an open-ended term like 'bias' that doesn't define itself legally, then it is unfair" to aggravate a person's sentence on grounds that it was committed out of bias.
Professor Katz is an expert on the law of nonprofit organizations. He teaches courses on the law of nonprofit and healthcare organizations, trusts and estates, the First Amendment, and law and religion. He also serves as co-counsel in civil rights litigation.
