Professor Georgakopoulos Cited by Majority in U.S. Supreme Court Ruling

The U.S. Supreme Court cited an article co-authored by IU McKinney Professor Nicholas Georgakopoulos in the case Agency for International Development v. Alliance for Open Society International, Inc.
In a 6-2 decision announced on June 29, the justices held that the enforcement of a law requiring foreign affiliates of domestic groups receiving funds to fight HIV/AIDS to have a policy opposing prostitution and sex trafficking does not violate the First Amendment.
Justice Brett Kavanaugh delivered the opinion of the Court, in which Chief Justice John Roberts and Justices Clarence Thomas, Samuel Alito and Neil Gorsuch joined. Justice Stephen Breyer filed a dissenting opinion, in which Justice Ruth Bader Ginsburg and Sonia Sotomayor joined.
The Supreme Court majority favorably mentioned Professor Georgakopoulos in the opinion: “Second, it is long settled as a matter of American corporate law that separately incorporated organizations are separate legal units with distinct legal rights and obligations. See Dole Food Co. v. Patrickson, 538 U. S. 468, 474– 475 (2003); Cedric Kushner Promotions, Ltd. v. King, 533 U. S. 158, 163 (2001); P. Blumberg, K. Strasser, N. Georgakopoulos, & E. Gouvin, Corporate Groups §§6.01, 6.02, 6.05 (2020 Supp.).”
Professor Georgakopoulos is the Harold R. Woodard Professor of Law. He produces scholarship in the intersection of business and uncertainty. He is the author of The Logic of Securities Law, Principles and Methods of Law and Economics, a coauthor of the multi-volume Blumberg on Corporate Groups, and numerous articles that have received broad citation, including previous opinions by the U.S. Supreme Court.
