Professor Nehf Discusses Consumer Rights with WTTV

A woman in Pendleton had some home repairs done after a tornado damaged her home in May 2019. The aluminum siding began to warp and shrink about a year after the repairs were made, and the company insisted the repairs were made properly. Television news station WTTV contacted Professor Jim Nehf, an expert in consumer law, for his insights on the story.
Unless a company states in its contract that it does not guarantee its workmanship, which should be a red flag to any consumer, then Indiana law provides a two-year if not indefinite warranty, Professor Nehf said.
“They cannot get out of their responsibilities by just saying, ‘Well, you signed off on the contract therefore you waived all of your rights and we’re off scot-free.’ That’s just not right,” Professor Nehf said in the story. He suggested the homeowner file a case against the company in small claims court.
Professor Nehf is the Cleon H. Foust Fellow and a John S. Grimes Fellow at IU McKinney. He has been teaching contracts, consumer law, and commercial law subjects for more than 20 years, and is an internationally recognized expert in consumer privacy and financial services law. He serves as an executive board member of the International Consumer Law Association, a global society of consumer law scholars and policy makers.
