Professor Terry Comments on New Law Cracking Down on Medical Marketing
10/04/2022
A new Indiana law explicitly bans the use of deceptive or misleading information by medical professionals in marketing materials, including clinic or hospital websites, billboards and commercials.
In an Indiana Business Journal article, “New law clamps down on certain medical titles in advertising,” IU McKinney Law Professor Nicolas Terry said, “This does appear to be part of the turf war, principally between doctors and advance practice nurses,” and cases involving this issue have gone to state supreme courts.
While some groups claim that laws are already in place to address false information, the American Medical Association (AMA) says laws such as the new one in Indiana are needed due to “scope creep” on the part of health care providers, such as nurses and physician assistants.
Professor Terry is the Hall Render Professor of Law and executive director of the Hall Center for Law and Health at IU McKinney, where he teaches healthcare and health policy courses. Since the COVID-19 pandemic reached the United States in early 2020, he has been a frequent speaker and media expert on the U.S. response and public health consequences.
