Professor Baker Discusses Indiana Law Concerning Impeachment

The Indianapolis mayor’s administration is facing a city-county council investigation into its handling of sexual harassment allegations against an employee. Indiana law doesn’t allow for recall elections, and according to state code, impeachment proceedings against mayors would be heard by the Indiana General Assembly. The General Assembly’s control over impeachment proceedings is reflective of local control issues that regularly play out during the legislative session, Professor Baker said in the story. “This statute hits on a nerve that is kind of baked into Indiana's state and local government system in which there is no constitutional home rule for the state's local governments,” she said.
Professor Baker is director of IU McKinney’s Program on Law and State Government.
